Target Breach Class Actions Take a Big Step Forward

Arent Fox Complex Litigation partner Joshua Fowkes wrote an article that was published by Corporate Counsel which focuses on a recent ruling involving the data breach of Target Corp. that gives banks a green light to continue with their class action suits against the company.

Elaborating on the suits, Mr. Fowkes explained that, “The court’s decision to allow the banks to proceed with statutory and common-law claims will likely encourage banks and financial institutions to raise similar lawsuits against merchants subjected to future cybertheft. But this decision is far from the last word on the case.” He continued, “Retailers and merchants that collect, store and use their customers’ personal information, along with companies that insure them, will undoubtedly be closely monitoring this case because of its significance to the emerging law regarding who will be liable for data breaches.”
